Data protection information for fine proceedings
Information pursuant to Section 40 of the Thuringian Data Protection Act (ThürDSG) on the processing of personal data for the prosecution and punishment of administrative offenses
1. purposes of processing - § 40 No. 1 ThürDSG
Personal data is processed for the purposes of the proper execution of fine proceedings.
Due to the large number of legal provisions (including laws, ordinances, statutes) that the Gera municipal administration enforces and on the basis of which fine proceedings can be conducted, it is not possible to provide an exhaustive and at the same time clear list of all legal provisions.
Personal data is also processed to fulfill statutory notification obligations and requests for information, such as
- Notifications for keeping the central trade register (Section 149 (2) No. 3 of the Trade Regulation Act)
- Notifications for keeping the driving aptitude register (Section 28 (3) No. 3 of the Road Traffic Act)
- Requests for information from the driving aptitude register (Section 30 (1) No. 2 of the Road Traffic Act)
In individual cases, personal data will be passed on to other authorities, such as the police, public prosecutor's office or administrative authorities, if there is suspicion of a criminal offense (Section 41 of the Administrative Offenses Act) or if the Gera city administration has no jurisdiction to prosecute and punish the administrative offense.
In connection with bug fixes to the software used or with the installation of new software or similar, personal data may also become known to software providers who are service providers of the Gera City Administration. The software providers offer sufficient guarantees that suitable technical and organizational measures are taken to ensure that they comply with data protection regulations and guarantee data protection.
2. rights of the data subject - § 40 No. 2 ThürDSG
In accordance with Section 42 ThürDSG, the Gera city administration will provide information on request as to whether it is processing data relating to the data subject. The data subject also has the right to receive information in accordance with Section 42 (1) sentence 3 ThürDSG.
Furthermore, there is the right to rectification, erasure and restriction of processing in accordance with Section 43 ThürDSG.
3. right to appeal to the State Commissioner for Data Protection - § 40 No. 4 and 5 ThürDSG
